For tax advisory firms

Clearly labelled, clearly set apart

The fee agreement must be labelled as such and clearly set apart from other agreements. It must not be part of the power of attorney. For every engagement, this means a separate agreement alongside the tax advisory contract.

What each engagement produces

The text is fixed, the engagement changes

What changes from case to case are the name, the services and the amounts.

The fee agreement

Ensure the text form (Textform) required by § 4(1) of the German Tax Advisers’ Remuneration Ordinance (StBVV). Generated as a separate document, clearly structured and kept apart from the power of attorney.

Type and scope of the engagement

They belong in every fee agreement, explicitly so since mid-2025. For ongoing engagements, that means listing the services covered by the flat fee.

The adjustment

If an engagement grows or its scope changes, a new agreement is made. With two hundred engagements, that is an ongoing process.

If the form is wrong

Then the ordinance applies

The requirements are in the ordinance itself: label it, set it apart, use text form, and keep it out of the power of attorney. If one of these requirements is missing, for instance because the agreement is part of the power of attorney, it is formally invalid. In that case the fee claim is limited to the statutory fees under the StBVV, regardless of what was actually agreed orally. DocuNorm ensures compliance with the statutory form requirements at system level: standardised templates rule out formal errors from the outset and ensure consistent fee agreements across your entire firm.
